Burns and scalds can be very painful and the level of pain and suffering one goes through whilst recovering from such an injury can be extreme. If you have suffered a burn or scald injury through no fault of your own, then you may be eligible for compensation.
You can make a claim for first degree, second degree or third degree burns, no matter how they were sustained, so long as you were not wholly liable for the accident in which you were injured. Most burns and scalds actual happen in the catering industry and especially so in places of work like kitchens. However you may have suffered a burn or scald as a customer of a business, such as through boiling water spillages or from very hot food.
Your right to make a claim, whether you had a burns accident at work or a burns accident while out, remains the same. You have the legal right to compensation if you have been injured through somebody else’s actions. And if you are suffering, then we would say that it is only fair and just that you get financial compensation to help you recover fully.
Making a claim for a burns accident time limits
You can make a claim whether you were burned in an accident at work, a road traffic accident, an accident in a school or nursery, an accident during surgery or an accident in a public place. However to make a claim, you must do so within three years from the date your injuries became clear, which in this instance is usually the date of your accident. After three years, personal injury claims become time-barred under UK law, which sadly means that they cannot be brought forward, unless so under exceptional circumstances. The only exception to this limit is if you have been treated under the Mental Health Act 1983.
If you were injured in a burns accident whilst a minor, then you have three years from the date of your 18th birthday to make a claim for financial compensation.
How much could I be awarded?
Due to the serious nature of burns and scalds, accidents of this type usually result in a minimum pay-out of £2,000. The more severe your injuries are and the bigger the impact they have had and will have on your life, the more compensation you can expect.
